Terms and conditions

Terms of use

Effective 7 October 2026

These terms of use (“Terms”) govern access to Echo and Tusker, the student learning service at echoandtusker.com and the companion mobile app that uses the same account (the “Service”). Tekeya LLC, having its registered office at Swastik, Mannancheriyil Villas, Chottanikara, Ernakulam, Kerala - 682312, provides and contracts for the Service and is referred to as the “Operator”, “we”, “us” or “our”. By creating an account or continuing to use the Service, you agree to these Terms and to the privacy policy.

1. Agreement and operator

The Operator is Tekeya LLC, Swastik, Mannancheriyil Villas, Chottanikara, Ernakulam, Kerala - 682312. These Terms, together with the privacy policy, are the agreement between you and the Operator for use of the Service.

2. Who may use the Service

You may use the Service only if you:

  • are at least 18 years old;
  • use the Service personally, or create and manage a child learner profile only if you are that child’s parent or lawful guardian;
  • provide accurate account, consent and purchase information;
  • create and operate the account, choose what the learner asks and studies, and supervise any child learner’s use;
  • keep sign-in details, verification codes and pairing codes secure; and
  • ensure that use is suitable for your own circumstances and, where applicable, the child learner’s age and schoolwork.

A “Learner” means either you when using the Service personally or a child whose learner profile you lawfully create and manage. A “Child Learner” means a Learner below 18 years of age. The Service is designed primarily for school-age children in grades 4 to 12, but an adult may use it personally. A child does not independently contract with the Operator. You are responsible for activity through your account except to the extent caused by our failure to apply safeguards required by law.

3. What the Service does

Echo and Tusker is a private, AI-assisted learning tool. A guardian may create learner profiles, choose a school board and grade, and ask the Service to help with syllabus-aligned learning. Supported functions include:

  • Ask Echo — answers to a question, walked back to the related lesson;
  • Explore with Tusker — a short course built from a question;
  • Practice with Mr.Sage — quizzes and practice that spend credits;
  • teach-back and review sessions;
  • published syllabus lessons where available; and
  • progress information shown to the guardian.

The Service is not a school, examination authority, publisher answer key, or a substitute for a teacher. It is not a digital textbook store.

4. Credits and payment

The Service offers prepaid credit packs. Credits pay for access to computing, AI processing and application functionality — they do not sell or licence a textbook or any publisher’s work. Packs, prices, taxes and what a credit buys are shown before you pay.

Payments are processed by Razorpay. Card, UPI and bank credentials are handled by Razorpay and are not intended to be stored by the Operator. A failed or cancelled payment adds no credits. Unused credits are not refunded if you delete your account. A second learner under the same guardian does not spend credits again for a Mr.Sage practice, Curiosity course or Teach the AI pack the family already has. Asking for a new one does spend credits.

Nothing in these Terms limits a non-excludable right under consumer law. We will not use pre-ticked consent, concealed charges or other misleading purchase practices.

5. Echo&Tusker Plus: subscription, cancellation and refunds

Plans
Plus is billed monthly (₹1,500 + GST) or annually (₹16,200 + GST, which includes a 10% discount versus twelve monthly payments). The price, GST and renewal date are shown before you pay. Plus renews automatically until cancelled.
Who can cancel
Only the parent or guardian who bought Plus can cancel it, from Plan & billing at echoandtusker.com. You can cancel at any time; no reason is required.
Monthly plan
Cancel any time before the renewal date. Plus stays active until the end of the period you have paid for, then ends. We do not refund a month that has already started.
Annual plan — refund
If you cancel an annual plan within the first ten months, we refund the unused part of your payment, less the annual discount for the months you used. Each month you have started (including part of a month) is charged at the monthly price of ₹1,500, not the discounted annual rate. Refund = ₹16,200 minus ₹1,500 × months started, plus the GST charged on that amount, never more than you paid. Example: cancel in month 4 and you receive ₹12,036 of the ₹19,116 paid. From the start of month 11 no refund is due and Plus ends at the end of the term.
Timing
The refund is started as soon as you confirm and returned to the original payment method by Razorpay, usually within 5–7 working days. We email you when it is started and when it completes. Bank timelines are outside our control.
What happens to access
After you cancel, Plus access continues until the end of the month you have already used (annual) or paid for (monthly). After that, only the first topic of each chapter stays open. Anything you obtained with credits — lessons you unlocked, Curiosity courses and threads, questions you asked, and Teach the AI courses you bought — remains available to you, and you can keep reading it. Other topics are locked until you resubscribe or unlock them with credits.
Credits
Credits are separate from Plus. Cancelling Plus does not remove, expire or refund credits. Credits spent are not refunded.
One refund
One refund applies per subscription. We may decline a refund we reasonably believe is abuse, and we correct any refund made in error. Complimentary access has no cash value and is not refundable.
Your rights
Nothing here limits a non-excludable consumer right. Refund questions: [email protected]; complaints: [email protected].

6. Questions and generated lessons

You retain the rights you have in questions, answers, optional page notes and other material submitted through the Service. You grant the Operator and its contracted processors a limited, non-exclusive, non-transferable (except to those processors), worldwide licence to receive, host, analyse and display that material solely to provide, secure, troubleshoot and support the requested lesson, and to review optional page notes so we can improve the Service.

This licence does not permit sale, advertising use, cross-user reuse, a shared content library, or general-purpose model training. Learner questions, chats, quizzes and generated lessons are not used to train general-purpose AI models. The licence ends when the relevant material is deleted, subject to backups, security evidence, legal preservation and statutory records.

For each submission, you represent that you have lawful access and the rights or legally permitted basis needed for the private learning use requested. You must not submit material in breach of copyright, confidentiality, privacy, contract or another person’s rights.

7. Acceptable use

You may use the Service only for lawful, private and non-transferable personal or household learning, including school homework, within the credits you have purchased or been allocated.

8. Prohibited use

You must not:

  • share account access or pairing codes to bypass a credit, school or security control;
  • scrape, resell, reverse engineer or commercially exploit the Service except where a restriction is prohibited by law;
  • submit identity documents, medical information, confidential records or another person’s private information without lawful authority;
  • submit child sexual abuse material, exploitative, illegal, hateful, violent or otherwise seriously harmful content;
  • upload malware or attempt to compromise or manipulate the Service;
  • misrepresent an affiliation with a publisher, school board or the Operator; or
  • use generated output for cheating, impersonation, harassment or other misconduct.

9. AI-generated output

Answers, courses, explanations, quizzes and teach-back feedback are generated with contracted AI processors (currently Anthropic’s Claude and OpenAI). Output may be incomplete, inaccurate, ambiguous or unsuitable. It is learning assistance, not official, publisher-approved or guaranteed to match a school or examination marking scheme.

The guardian should review output before relying on it, especially for assessments, sensitive content or matters requiring professional judgment. A parent or lawful guardian must supervise a Child Learner’s use. The Service is not medical, psychological, legal or other professional advice. Report material errors through support.

A rights owner or authorised representative may complain through [email protected]. The complaint should identify the protected work, the affected material or account, the complainant’s authority and reliable contact details.

We may preserve relevant evidence, restrict processing or access, request supporting information, remove material and apply repeat-abuse controls. Urgent legal, security or safety action may be immediate.

11. Echo and Tusker intellectual property

The Service, software, interface, mascots, branding and original or licensed in-house learning content are owned by or licensed to the Operator. During an active account, we grant you a limited, revocable, non-exclusive, non-transferable licence to use them privately through the Service.

No licence is granted to publish, sell, extract at scale, train a model on, create a competing dataset from or otherwise exploit the Service or Operator content.

12. Privacy

The privacy policy explains how guardian information, learner profiles, activity, questions and output are processed. Processing a lesson requires the data described there. Child-specific consent and protection provisions apply whenever a Child Learner profile or a child’s personal data is processed.

13. Third-party services

The Service relies on contracted providers, including Zitadel for sign-in, Razorpay for payments, Anthropic and OpenAI for supported AI functions, cloud hosting, and optional Plausible analytics. Optional in-browser dictation may use the browser’s speech service (Google in Chrome). Their services may have additional terms. We remain responsible for our obligations under applicable law.

14. Availability and changes

We do not guarantee uninterrupted availability. Maintenance, connectivity, device compatibility, provider outages, security events and legal requirements may affect access. We may improve, replace or discontinue features. If a material change adversely affects prepaid credits you have already paid for, we will provide the notice, credit, refund or other remedy required by the purchase terms and applicable law.

15. Suspension and termination

We may restrict or suspend an account where reasonably necessary for unlawful material, a security or child-safety risk, payment failure, repeated infringement, circumvention or a material breach. We will provide notice and a reasonable opportunity to respond where appropriate; urgent legal, security or safety action may be immediate.

You may delete the account from parent space or by writing to [email protected]. Access ends when the account is marked deleted. Remaining account data is permanently removed after a short grace period, as described in the privacy policy. Cancellation of a payment, account deletion and data purge are distinct. Unused credits are not refunded on deletion.

16. Consumer rights and disclaimers

To the extent permitted by law, the Service is provided on an “as available” basis and AI output is not warranted to be error-free, complete or suitable for every educational purpose. We do not exclude warranties, remedies or rights that cannot lawfully be excluded, including applicable rights under the Consumer Protection Act, 2019.

17. Limitation of liability

To the extent permitted by law, neither party is liable to the other for indirect, special or consequential loss that was not reasonably foreseeable when the credits were purchased. Subject to the following sentence, the Operator’s aggregate contractual liability arising from a paid pack will not exceed the fees paid for that pack and the preceding six months of Service.

The limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence where liability cannot be limited, breach of confidentiality or data-protection obligations to the extent they cannot lawfully be limited, infringement by Operator content, or mandatory consumer remedies.

18. Governing law, grievances and disputes

These Terms are governed by Indian law. Please first contact [email protected] so we can attempt resolution within the period required by applicable law. You retain the right to approach a competent consumer commission, regulator or court where applicable.

Subject to non-excludable consumer forums and other mandatory jurisdiction, courts competent at Ernakulam, Kerala will have jurisdiction.

19. Changes to these Terms

We may revise these Terms when the Service, packs or law changes. We will display the effective date and give reasonable advance notice of a material adverse change. Fresh acceptance will be obtained where required. We will not introduce child advertising, cross-user content reuse, or general-purpose model training on learner questions through a Terms update alone.
